1. Scope of Application
The following General Terms and Conditions (GTC) apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.
A consumer is any natural person who enters into a legal transaction for purposes that cannot be primarily attributed to their commercial or self-employed professional activity. An entrepreneur is a natural person, legal entity, or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.
2. Contractual Partner, Formation of Contract, Correction Options
The purchase contract is concluded with Rosa Canina Chocolate – Berliner Schokoladen Manufaktur 31° GmbH.
By placing products in the online shop, we submit a binding offer to conclude a contract for these items. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process.
The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive an additional confirmation by email.
3. Contract Language, Storage of Contract Text

We store the contract text and send you the order details and our General Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the internet.
4. Delivery Conditions
Shipping costs are added to the product prices shown. Details regarding the amount of shipping costs can be found in the respective product offers.

5. Payment
The following payment methods are generally available in our shop:
Advance Payment
If you select advance payment, we will provide our bank details in a separate email and deliver the goods after receipt of payment.
Credit Card
When placing your order, you provide your credit card details. After verification that you are the legitimate cardholder, the payment transaction is automatically carried out and your card is charged.
Credit Card via PayOne
In cooperation with the online provider PayOne, we offer credit card payment as an option. When placing your order, you provide your credit card details and we assign our claim against you to PayOne. After verification that you are the legitimate cardholder, the payment transaction is automatically carried out immediately after receipt of the goods, and your card is charged by PayOne.
Klarna PayNow Direct Debit
After successful address and creditworthiness checks during the ordering process, you grant the online provider Klarna a SEPA direct debit mandate when submitting your order. Klarna will inform you of the date on which your account will be debited (so-called pre-notification). By submitting the direct debit mandate, Klarna requests your bank to initiate the payment transaction. The payment transaction is automatically carried out and your account is charged. The account will be debited after the goods have been shipped.
For payment processing via Klarna, Klarna’s terms and conditions and privacy policy also apply in addition to our GTC. Further information is provided during the ordering process.
PayPal, PayPal Express
During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must either already be registered with PayPal or register, authenticate yourself using your login details, and confirm the payment instruction to us.
After placing your order in our shop, we request PayPal to initiate the payment transaction. The payment transaction is automatically carried out by PayPal immediately afterwards. Further information will be provided during the ordering process.
Sofort by Klarna
After placing your order, you will be redirected to the website of the online provider Sofort GmbH. To pay the invoice amount via Sofort, you must have a bank account enabled for online banking, authenticate yourself accordingly, and confirm the payment instruction to us.
Further information will be provided during the ordering process. The payment transaction is carried out immediately afterwards by Sofort and your account is debited.
Apple Pay
To pay the invoice amount via Apple Pay, you must use the Safari browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your login details, and confirm the payment instruction.
The payment transaction is carried out immediately after placing the order. Further information will be provided during the ordering process.
Google Pay
To pay the invoice amount via Google Pay, you must be registered with Google, have activated Google Pay, authenticate yourself with your login details, and confirm the payment instruction.
The payment transaction is carried out immediately after placing the order. Further information will be provided during the ordering process.
Giropay
After placing your order, you will be redirected to your bank’s website. To pay the invoice amount via Giropay, you must have a bank account enabled for online banking, authenticate yourself accordingly, and confirm the payment instruction to us.
Further information will be provided during the ordering process. The payment transaction is carried out immediately afterwards and your account is debited.
Amazon Pay
During the ordering process, you will be redirected to the Amazon website before completing the order in our online shop. To process the order and pay the invoice amount via Amazon, you must either already be registered with Amazon or register and authenticate yourself using your login details.
There you can select the delivery address and payment method stored with Amazon, approve the use of your data by Amazon, and confirm the payment instruction to us. You will then be redirected back to our online shop, where you can complete the order process.
Immediately after placing the order, we request Amazon to initiate the payment transaction. The payment transaction is automatically carried out by Amazon. Further information will be provided during the ordering process.
Purchase on Invoice via Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer purchase on invoice as a payment option.
Please note that Klarna invoice payments are only available to consumers and that payments must always be made directly to Klarna.
When purchasing on invoice with Klarna, you will always receive the goods first and you always have a payment period of 14 days.

6. Retention of Title
The goods remain our property until full payment has been received.
7. Transport Damage
If goods are delivered with obvious transport damage, please report such defects to the delivery agent as soon as possible and contact us immediately.
Failure to make a complaint or contact us has no consequences for your statutory rights or their enforcement, particularly your warranty rights.
However, your cooperation helps us to assert our own claims against the carrier or the transport insurance company.
8. Warranty and Guarantees
Our chocolate products are subject to the food law regulations applicable in Germany.
If, despite our careful quality control, the products delivered by us have obvious defects or missing quantities, please report these immediately (within 7 days) in writing to the following address:

Please note that minor deviations in size, colour, shape, and workmanship are completely normal due to the handmade production process and do not constitute a defect. For non-obvious defects, the complaint period is six months.
Please ensure that any transport damage is confirmed by our delivery service provider upon receipt of the goods.
We guarantee the quality of our products when stored properly (below 18°C, relative humidity between 50–70%, and protected from light) for the following periods:
Chocolate products: 12 months from the date of delivery.
If defects occur in the chocolate products supplied by us within this period, we will refund the agreed purchase price upon proof of the defect.
For entrepreneurs, only our own specifications and the manufacturer’s product descriptions that have been incorporated into the contract shall be deemed an agreement regarding the condition of the goods. We assume no liability for public statements made by the manufacturer or other advertising claims.
If the delivered goods are defective, we shall initially provide warranty services to entrepreneurs, at our discretion, either by remedying the defect (repair) or by supplying defect-free replacement goods.
The above limitations and reductions of time periods do not apply to claims based on damages caused by us, our legal representatives, or our agents:

in the event of injury to life, body, or health;
-
in the event of intentional or grossly negligent breach of duty or fraudulent concealment;
-
in the event of a breach of essential contractual obligations, the fulfilment of which is necessary for the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations);
-
within the scope of a guarantee commitment, where applicable;
-
insofar as the scope of application of the Product Liability Act applies.

9. Liability
We shall always be liable without limitation for claims arising from damages caused by us, our legal representatives, or our agents:

in the event of injury to life, body, or health;

in the event of intentional or grossly negligent breach of duty;

in the event of guarantee commitments, where applicable; or
-
insofar as the scope of application of the Product Liability Act applies.
In the event of a breach of essential contractual obligations (cardinal obligations) by us, our legal representatives, or our agents due to slight negligence, where such obligations are necessary for the proper execution of the contract and on which the contractual partner may regularly rely, liability shall be limited in amount to the foreseeable damage that is typical for this type of contract and could reasonably have been anticipated at the time the contract was concluded.
Otherwise, claims for damages are excluded.
10. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which can be found here.
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Youth Protection
If your order includes goods whose sale is subject to age restrictions, we ensure, through the use of a reliable procedure involving personal identity and age verification, that the purchaser has reached the required minimum age.
The delivery service provider will only hand over the goods after successful age verification and only to the purchaser personally.
